Congress Faces Continuing Gap in State Department Authorization

    Why It Matters

Congress has not enacted a comprehensive Department of State (DOS) authorization since 2002, and annual appropriations bills have carried standing waivers of that requirement since at least fiscal 1999, according to a new Congressional Research Service (CRS) report.

The report warns that appropriators have increasingly filled that vacuum, inserting foreign policy directives and reporting requirements into spending bills in ways that “some may assert” have shifted primary congressional engagement in foreign policy away from the House Foreign Affairs Committee (HFAC) and the Senate Foreign Relations Committee (SFRC).

In the 119th Congress, some members and observers have raised concerns that the executive branch conducts foreign policy without sufficient recognition of congressional prerogatives.

    The Big Picture

The fiscal year 2026 appropriations law (P.L. 119-75, Division F, §7022) again waived DOS authorization requirements, extending a practice the report traces to at least fiscal 1999. The last comprehensive DOS authorization covering multiple appropriations accounts was P.L. 107-228, enacted in 2002 for fiscal 2003; since then, Congress has enacted six authorizing laws covering selected programs.

Beginning in the 117th Congress, Congress began attaching DOS authorizations to National Defense Authorization Acts (NDAAs), and it has enacted five DOS authorization laws since 2021, enacted in part by attaching them to NDAAs. The report notes that the approach has limits: the fiscal year 2021 NDAA omitted a DOS authorization title, reportedly over disagreements about the Women’s Global Development and Prosperity Initiative.

Two active 119th Congress bills illustrate what HFAC is weighing:

    • The Foreign Service Modernization Act (H.R. 9086), sponsored by Rep. Michael Lawler (R-NY), remains at the introduced stage, with its latest action a June 2 referral to the Foreign Affairs Committee and, in addition, to the Ways and Means Committee.
    • H.R. 8668, the State Department Recurring Reports Repeal and Sunset Act of 2026**** was referred to the House Foreign Affairs Committee on May 7, and remains in committee.

The report identifies a remaining question: whether HFAC and SFRC leadership could build votes for a stand-alone authorization, given that some members who backed NDAA-attached bills may oppose a stand-alone measure containing objectionable provisions.

    The Bottom Line

Senate Foreign Relations Committee Chair Jim Risch (R-ID) and Ranking Member Jeanne Shaheen (D-NH) submitted S.Amdt. 6559 on June 24 to the fiscal year 2027 NDAA (S. 4784), which would redesignate the U.S. Agency for International Development Inspector General within the Department of State, extend limited noncareer appointment terms from five to eight years, and require AI-use disclosure in Department of State reports to Congress. S. 4784 has not advanced beyond a July 27 motion to proceed in the Senate, leaving S.Amdt. 6559 pending.
